European legislation and professions: what an AI Officer is today

The professional role of the AI Officer cannot be fully understood unless it is situated within the trajectory of recent European legislation, starting with the AI Act and the broader regulatory ecosystem that includes the GDPR, the Digital Services Act, and the Digital Markets Act. We are no longer dealing with a vertical compliance function, but with an organizational node positioned at the intersection of multilevel regulation and corporate decision-making architecture.

Within the framework outlined by the AI Act, in particular, the AI Officer is called to operate within a structural logic of risk management, as clearly emerges from the structure of Article 9 on the risk management system: not an ex-post verification, but a continuous, iterative process embedded in the system’s lifecycle. This implies that the function does not merely “monitor” AI, but helps design the very conditions of its operational legitimacy. In other words, it transforms regulatory obligations into competitive levers, integrating governance, innovation, and accountability in a way that is consistent with the European rationality of risk.

The required aptitude is inevitably hybrid, but not in a generic sense. It is a hybridization instrumental to a specific European regulatory model: one that attempts to reconcile the classificatory logic of risk with the dynamic and interconnected nature of artificial intelligence systems. The AI Officer must understand technological models (including their opacity), interpret risk from an organizational perspective, and translate legal requirements, often formulated in abstract terms, into concretely scalable business processes. Here, a first tension emerges: while European law tends to typify (high-risk, prohibited, limited risk), real-world AI escapes these static categories. It is precisely the AI Officer who must bridge this gap.

In this sense, the function takes on a genuinely decision-making dimension. It is an actor that shapes strategic choices: allocation of investments, selection of models, integration into core processes, and definition of performance metrics. The implicit reference is also to Article 26 of the AI Act, which assigns specific obligations to deployers, from the adoption of appropriate technical and organizational measures to effective human oversight. These obligations directly affect how a company decides to use AI, and therefore its competitive positioning.

In practical terms, the role is structured along three operational directions, all deeply rooted in European legislation.

  • The first is the construction of adaptive governance frameworks capable of integrating the AI Act, the GDPR, and sector-specific regulations (for example, the interaction with cybersecurity rules or future developments of the so-called Digital Omnibus).
  • The second is the implementation of assessment tools, including the fundamental rights impact assessment (FRIA), which represents the most advanced point of contact between compliance and digital constitutionalism: not merely risk analysis, but verification of compatibility between automated decision-making and the architecture of rights.
  • The third is the construction of clear, documented, and verifiable chains of responsibility, in line with the growing European emphasis on accountability as an organizational principle, not merely a legal one.

It is precisely on this point that a qualitative leap emerges: the objective is not simply to avoid sanctions, but to make artificial intelligence reliable, auditable, and above all governable. In a context where— as shown by the first implementation tensions of the DMA and the DSA—regulation struggles to keep pace with technological transformation, the AI Officer becomes the place within the organization where this friction is managed, translated, and, to some extent, resolved.

From this perspective, the AI Officer is both a guarantor and an enabler. They reduce regulatory uncertainty by anticipating the impacts of European rules, accelerate a conscious adoption of AI by avoiding opportunistic or purely defensive drifts, and help build trust, both internally and externally, as a competitive infrastructure. In the European model, such trust is not a byproduct, but an explicit regulatory objective.

Ultimately, the point is that the AI Officer embodies a broader transformation: the shift from the regulation of behaviors to the regulation of decision-making architectures. In this transition, the ability to integrate law, technology, and strategy is no longer an ancillary advantage. It is the very condition for operating in the European artificial intelligence market.
